Andrew C. McCarthy, National Review columnist and legal analyst for Fox News, returns to the Dom Giordano Program to break down, in-depth, yesterday’s verdict for Derek Chauvin in the trial regarding the murder of George Floyd. First, McCarthy answers how a person can be charged for the same crime with three different charges, and explains whether or not he will be sentenced for all three crimes. Then, McCarthy gives his opinion on the three charges, explaining that he doesn’t agree with the decision on third-degree murder, explaining that as a matter of textbook criminal law, depraved indifference is defined differently than the situation as it played out in the Chauvin case. Also, McCarthy explain why, in his opinion, although he agrees with some charges, Chauvin didn’t receive due process. Finally, McCarthy and Giordano discuss the situation involving Officer Kim Potter, who killed Daunte Wright after allegedly planning to use a Taser to de-escalate a traffic stop.
